The idea was to warn clueless surfers like myself that Big Government is poised to stage a Beijing-style crackdown on our digital freedom and, presumably, to rally us in defense of the unfettered Internet in which behemoths like Google, Facebook and eBay have thrived.
But I suspect that most of us were as confused by web-wide protest as we are when some company whose software we may or may not be using alerts us to a security concerned that our computers are in mortal jeopardy, but uncertain whether the proffered patchis adata-saving fix or a hard drive-wrecking virus in disguise. The old vs. the new The targetsof Internet blackout were bills that are ostensibly designed to crack down on foreign websites that infringe on copyrights held by American content producers. The Stop Online Piracy Act (SOPA), co-sponsored by own U.S. Rep.
John Conyers, is pending in the U.S. House. The similar Protect Intellectual Property Act (PIPA) has already won the unanimous approval of the Senate Judiciary Committee and was scheduled for an important test vote next week, at least until web offensive drove several previously sympathetic senators into headlong retreat. Until this week, negotiations surrounding the bills had been portrayed as a skirmish between old media companies filmmakers, print publishers, and TV and music producers and new-media heavyweights such as Google and Yahoo, whose content- producers it easier for users to locate and download copyrighted material pirated by offshore websites. Contested language in SOPA and PIPA would give the government new powers to crack down on Internet companies thatprovide a pathway to pirated material and shut down entire websites for linking to copyright-protected material.
But major web portals such as Google and Wikipedia say they already work diligently to protect copyrighted material from unauthorized use, and that the proposed provisions would a framework for future restrictions and suppression of Internet on your Ilike to consider myself a champion of the First Amendment. Whatever anti-piracy legislation survives their scrutiny may be a marked improvement over the original, but whether any of them is looking out for you and me remains to be seen. copyright owners and producers billions of dollars every year, but legislation in Congress to block foreign Internet thieves and swindlers has met strong resistance from high-tech companies, spotlighted Wednesday by Wi- 24-hour protest blackout, warning of a threat to Internet freedom. Google blacked out the logo on its home page, directing surfers to a page where they could add their names to a petition against the House and Senate bills that once seemed to be on a path toward approval. Those bills now face a rockier future as lawmakers including several who were listed as sponsors said Wednesday that they would withdraw their support. House Speaker John Boehner, R-Ohio, said it was clear to many of us that there is a lack of consensus at this Here are some of the ques- tions being raised about the bills: QUESTION: Why is legislation needed? ANSWER: It aims to protect artists, innovators and industries from copyright thieves and shield consumers from products sold on the Internet that are fake, faulty and unsafe. workers a year. The pharmaceutical in- dustry loses billions to people who sell drugs on the Internet that are falsely advertised and may be harmful. Q. What is Congress trying to accomplish? A. The two main bills are the Protect Intellectual Property Act, or PIPA, in the Senate, and the similar Stop Online Privacy Act, or SOPA, in the House.
There are already laws on the books to combat domestic web- sites trafficking in counterfeit or pirated goods, but lit- tle to counter foreign violators. The bills would allow the Department of Justice and copyright holdersto seek court orders against foreign websites accused of perpetrating or facilitating copyright infringement. Although there is little the U.S. can do to take down those websites, the bills would bar online advertising networks and payment facilitators such as credit card companies and PayPal from doing business with an alleged violator. It also would forbid search engines from linking to such sites.
Q. So why the concern? A. Critics say the bills would constrain free speech, curtail innovation and discourage new digital distribution methods. Internet service providers and social networks could be forced to shut down websites linked to any type of pirated content. In addition, critics contend that developing businesses and smaller websites could be saddled with expensive litigation costs.
And, they rights holders could impede new investment in the technology sector. Q. Who else supports the bills? A. The most visible supporters are entertainment-related as the Motion Picture Association of America and the National Music Association. But the bills also enjoy support from the pharmaceutical industry, theU.S.
Chamber of Commerce and several law enforcement groups. Q. Who are the opponents? A. In addition to Wikipedia, the legislation is opposed by major Internet and technology companies, including Google, Facebook, Craigslist, Am- azon.com and eBay. Political groups ranging from the liberal Democracy for America to the conservative Heritage Action have also voiced concerns.
